Celebrity Justice
Prosecutor to Rodriguez -- You're Pretty in Orange

UPDATE: Rodriguez dodged a little bullet today, when the judge in the case continued this matter until October 12. The judge ordered, however, that the "Lost" star complete 16 hours of community service -- picking up trash on the side of the road. Fast and furious!

The L.A. City Attorney thinks actress Michelle Rodriguez is a slacker who has violated probation and should have the book thrown at her.
Exclusive: Michelle Rodriguez
TMZ has obtained documents, filed Thursday in Los Angeles County Superior Court, in which the City Attorney says Rodriguez, who starred in "Lost," has repeatedly failed to complete the terms of her probation for a variety of crimes, including hit and run, driving with a suspended license and DUI. According to the documents, Rodriguez violated her probation numerous times by not performing community service and not following her alcohol monitoring program. The judge in the case has ruled several times that she did indeed violate her probation.

Now the City Attorney has had it. He now says, "If Ms. Rodriguez fails to accept responsibility for her actions and fails to admit that she is in violation of her probations ..." she should be ordered to serve the maximum sentence. Forget 82 minutes! Rodriguez' sentence could compute out to as much as 537 days in L.A. County Jail.

The City Attorney says if Rodriguez owns up to what she's done, he still wants "substantial jail time" but not the max.

31. Michelle Rodriguez isn't all that, so why would she think she's above the law?

32. Yeaaahhh, why do celebrities continue to get breaks when they dont comply?? I would not be given such breaks if I didnt comply...once, maybe...but more than that? Noooo. Judge would tell me this 2nd appearance is spending tax dollars incorrectly. Everyone knows the punishment detail. No chances past that 2nd appearance - and, it better have been missed for a reasonable reason. She probably just refused to ccept that she had to comply...and refused to do so. Shes forfiets any further considerations. The end. You go into a little cell for the year. Never to hear a dog bark, never to see the mighty Pacific, never to have lunch on Wilshire Blvd....for an entire year. Just stand, sit, and squat in yer animal cage. Ignorant twit.

33. Dui is a serious matter BUT I have to say as someone recently arrested for this, it is also something that can happen rather innocently. Say what you may and I know it is wrong, but I was at the beach, it turned cloudy, I had a rental car and was not used to it as my car was being repaired, and after a few glasses of wine with a friend I decided to go home...daytime no big party! I was pursued by a car of obnoxious guys that were exposing themselves, mooning me and asking for my number. I changed lanes until I was as far left as I could get, they closed in and nearly cut me off, I hit the median and totalled the car. THANKFULLY nobody including myself was hurt. The officer arrived at the scene, I was outside my car and he commented he smelled alcohol....once they make that decision its over for you and all cards are stacked against you. HE DID NOT take my story seriously and a witness who saw the guys coming after my car was told to leave the scene. In the meantime they asked me to perform to roadside sobreity tests, I did not fail the first one becuase it was performed incorrectly. I asked several times if I had the right to an attorney before taking the tests and was told "why, you are not under arrest"." I then failed the one leg stand which I was doing on a freeway in old sandal heels that I later tried the same test sober with and could not stand because they were so worn thus why I had them at the beach. I was taken for a breathalyzer to the station and when I passed they asked me two more times to keep breathing deeper and do it, then told me I was over the limit and under arrest for DUI. NO MIRANDA and again asked about an attorney at the station and the question was skirted. I was told I was being booked BUT did not need to get bonded as I would be out in 8 hours, THIS WAS A LIE. I was told when I asked at 1am if I was almost ready for release then the officers laughed and said, "Who told you that you would get out, you are here until Monday we are transferring you to the womens correctional facility". I then panicked and asked for my call which I was denied. I was cavity searched at booking in front of many other women and then again when the transferred me to a disgusting overcrowded cell with mattresses all over meant for 4 people but housing 12. At 10am the next day I was allowed a call and got someone to bond me, it was 13 hours before I was released. They never communicated with me, I spent 36 hours behind bars with REAL hardened criminals and was never even allowed a drink but for twice during the entire time (water that is). I think celebrities get off so easy when you look at what I went through for 3 glasses of wine. I am now paying 7k for a lawyer and risk having my license suspended from the DMV and also have a pending trial. I NEVER in my life broke a law before and always take a taxi if I feel drunk. The moral of the story is NO alcohol is ok to drive on if you are a mere mortal and the cards are stacked against you. The officer did not even mention that I exhibited any signs of intoxication other than his smelling it on me. Is life fair? Not for us mortals!

37. To Dawn Day -

You have to BE in CA before you get in trouble! Every other state doesn't put up with it. They build more jails as the fill up, NOT HERE!

Sad story but you where involved in a car wreck that totaled your car and could had killed others but you where lucky there. Cops where being way harsh on you true and if your story where to hit the local papers I'm sure most will side with you, but not on the internet losers like the ones you see here and there they'll say things like LIEING DRUNKING WHORE! and other mean nasty evil stuff like that. And if the press did get involved in your story and made an local celebrity out of you cuz of this then you'll be in for some real serious legal trouble cuz then the big guys will get involved and they'll want to throw the book at you and try to make an "example' out of you. I'm sure if this where to happen to you the first two things out of your mouth will be "It's not my fault" and "it was just a simple DUI".

Give Michelle Rodriguez a break cuz she would give you one and prolly ask you out if you're cute. ;)

39. Who is Michelle Rodriquez? Seems like a bitter lesbian hell bent on getting her skankness locked up.

Posted at 12:50AM on Sep 29th 2007 by FlBiker

40. My God. We have laws so that EVERYONE is protected to a reasonable degree of safety from EVERYONE else. It's no one's problem except Michelle's that she seems unable to be a law abiding and safe citizen. I want her locked her up and paying penance until she can drive a car sober and abide by the rest of the laws. Otherwise, I pray that she gets royally drunk and drives a car at 130 mph over an embankment above an unoccupied beach and kills herself.

41. LOL. You people act like she has driven drunk since she was arrested.

She hasn't.

Who cares if she stumbles out of a club drunk if she isn't driving.

42. I don't know what to say. This sucks. She's at such a good place in her life right now. For this to come back to haunt her over a misunderstanding breaks my heart. I'll be thinking of her and hoping for the best. And unlike the bashers, I know where to find it. So until then, i'll just cross my fingers for her. :)

That which don't kill you, can only make you stronger.

43. Maybe Michelle, Paris, Lindsay and Nicole can all unite and make a fragrance called--
'Narcissus Probation Bliss'.

44. Lexi, (post #33)

People aren't here to read War and Peace. Next time, keep it to a small paragraph so people might take the time to read it.

Remember, this TMZ....not the NY Times

45. re: 10. I dont get it why can Lindsay, Paris and Nicole get away with breaking the law but Michelle cant. Does race have something to do with it ?

Posted at 2:36PM on Sep 28th 2007 by Shovan

Well, since the last time Michelle was told to turn her self over to the jail she was released a few hours later, and Paris served what 23? Days . . . I don't think this is a race thing.
